WHAT ARE DIRECTIVE PRINCIPLES OF STATE POLICY?

  • The Constitution makers felt that bringing about equality and well-being of all citizens would be a major challenge of independent India
  • To achieve this, they added some policy directions to the future Governments known as Directive Principles of state policy

WHAT DO THE DIRECTIVE PRINCIPLES CONTAIN?

  • Directive Principles lists mainly three things:
  1. The goals and objectives that we as a society should adopt
      • Protection of monuments
      • Promotion of International peace
      • Uniform Civil Code

WHAT DO THE DIRECTIVE PRINCIPLES CONTAIN?

  1. Certain rights that individuals should enjoy apart from Fundamental Rights
      • Free Legal Aid
      • Free and Compulsory Education
      • Minimum Wage, Humane work conditions

WHAT DO THE DIRECTIVE PRINCIPLES CONTAIN?

  1. Certain policies that Government should adopt
      • Duty of state to raise standard of living of people
      • Organisation of Village Panchayats
      • Promotion of Cooperative Societies
      • Separation of Executive and Judiciary

DIFFERENCE BETWEEN FUNDAMENTAL RIGHTS AND DPSPS?

Fundamental Rights

Directive Principles

Restrain the government from doing certain things

Encourage the government to do certain things

protect the rights of individuals

ensure the well-being of the entire society

Are justiciable - must be enforced by the judiciary

Are non-justiciable - cannot be enforced by the judiciary

 

WHY ARE DPSPS MADE NON-JUSTICIABLE?

  1. The Constitution did not want future governments to be bound by certain policy decisions and
  2. To give future governments, the required freedom to evolve with the changing needs of the society
