IMPEACHMENT OF PRESIDENT OF INDIA
WHO IS PRESIDENT OF INDIA?
- Articles 52 to 78 in Part V of the Constitution deal with the Union executive.
- The Union executive consists of the
- President
- Vice President
- Prime Minister
- Council of ministers
- Attorney General of India
- The President is the Head of the Indian State.
- She is the first citizen of India.
- She acts as the symbol of unity, integrity and solidarity of the nation.
WHAT ARE THE QUALIFICATIONS FOR PRESIDENT?
- Indian Citizenship
- Minimum Age: 35 Years
- Not hold office of Profit
- Qualified to be a Lok Sabha Member
CAN PRESIDENT OF INDIA BE IMPEACHED?
- Yes, President of India can be impeached.
- Violation of Indian Constitution.
- Misbehaviour.
MEMBERS TO VOTE IN IMPEACHMENT
- All members of Lok Sabha: 543
- All members of Rajya Sabha: 245
IMPEACHMENT PROCESS
- Resolution supported by ¼ of total membership of Either Lok Sabha or Rajya Sabha.
- Resolution is forwarded to Speaker or Chairman.
- 14 days time is given to the President.
- Voting in Lok Sabha & Rajya Sabha: 2/3rd of total members.
- Resolution has to be passed by both of the house of the Parliament.
- If passed, President is impeached.
WHAT NEXT AFTER THE IMPEACHMENT?
- After the impeachment:
- Vice President becomes the Acting President.
- And within 6 months, new President elections must be held.
