WHO IS STATE ADVOCATE GENERAL?
- He is the highest law officer of respective State, appointed by Governor.
- He works under the pleasure of President with no specific tenure.
WHAT ARE THE QUALIFICATIONS FOR STATE ADVOCATE GENERAL?
- Indian Citizenship
- Qualified to be judge of High Court
WHAT ARE THE DUTIES & FUNCTIONS OF SAG?
- To advice State Government on legal matters.
- To fight cases for State government & to represent State government in High Court.
- To represent Governor in Advisory Jurisdiction
WHAT IS THE REMOVAL PROCEDURE FOR SAG?
- There is no specific removal process of State Advocate General.
- He works under the pleasure of the Governor.
- He can also resign to the Governor.
- He conventionally resigns when State Councils of Ministers resign.
WHAT ARE THE RIGHTS OF SAG?
- He can visit any Court in State without any permission.
- He can sit in Legislative Assembly, Speak, take part in discussion but can’t vote.
- He can become member of any Legislative assembly Committee when asked.
WHAT ARE THE LIMITATIONS ON SAG?
- He should not advice or hold brief against State Government.
- He can’t defend accused person in criminal cases without permission of State Government.
- He can’t be appointed as director in any company or cooperation without Government’s permission.
WHAT ARE THE PRIVILEGES OF SAG?
- Article 194: Same privileges as Member of Legislative Assembly.
- Article 177: Rights of State Advocate General as respects the Houses of state Legislature and its committee.
