WHAT IS SPSC?
- It is the State’s recruiting agency.
- It is an independent Constitutional body.
- Articles 315 to 323 in Part XIV of the Constitution contain elaborate provisions regarding
- Composition, appointment and removal of members.
- Independence, powers and functions of the SPSC.
WHAT IS THE COMPOSITION OF SPSC?
- All the members and chairman are appointed by the Governor of the respective State.
- The total strength of SPSC members is not even specified in the constitution.
- This strength is decided by the State Governor itself.
WHAT ARE THE QUALIFICATIONS FOR SPSC?
- The qualifications of members and Chairman are also not described in Constitution.
- At least 50% of the members should have the experience of working in State and Central Government.
WHAT ARE THE FUNCTIONS & ROLES OF SPSC?
- SPSC is the watchdog of merit system of that State.
- It conducts examinations of Civils services exam and other exams in the State.
WHAT IS THE REMOVAL PROCEDURE FOR SPSC?
- Although the members and chairman of SPSC are appointed by the Governor but they are removed by the President of India.
- The President can remove the chairman and members in the following circumstances:
- If he has gone bankrupt.
- If he engages in any paid employment outside the duties of his office.
- If he is unfit to continue in the office according to the President.
- The President can also remove the chairman and members based on misbehaviour.
- The president has to refer this case to the Supreme Court.
- Supreme Court will do enquiry over this and will make the report and would give advice to President.
- The advice will be binding on the President on removal or not for removal.
- Note: while the enquiry is going on the Chairman and member, the President can suspend them.
HOW SPSC IS AN INDEPENDENT BODY?
- They enjoy security of tenure because they are removed by a proper process.
- Their expenses are being charged on Consolidated Fund of State.
